Anti Sexual Infidelity Bill (HB 5734)




The House Committee on Women and Gender Equality has approved and endorsed to the plenary House Bill (HB) 5734, an Act Defining the Crime of Sexual Infidelity, that would penalize a married person who engage in sex with an individual other than his/her legal spouse.

HB 5734 defines sexual infidelity as “an act committed by any legally married person who shall have sexual intercourse with another person other than his or her legal spouse,” according to reports.

The bill is aimed to “protect the institution of marriage,” reports said.

The proposed law reportedly said that if the crime happens within the home of the married couple, the party found guilty of sexual infidelity will be penalized with prision correccional in its “maximum period.” If it happens somewhere else, the party guilty of the crime will be meted with prision correccional in its “medium period.”

Article 27 of the Revised Penal Code states that the duration of prision correccional shall be from “six months and one day to six years.”
